What a Democratic Congress means for Bitcoin and crypto regulation

Crypto regulation in the United States could take a new direction following Democrats' sweeping victory in the November 3 US midterm elections. The party is reportedly preparing to revisit crypto market structure proposals that failed to gain support during Republican-led negotiations.

The shift could have strong implications for an industry that spent years arguing against what it described as “regulation by enforcement,” as the Securities and Exchange Commission (SEC) pursued crypto companies over alleged securities violations without a comprehensive framework defining how digital assets should be regulated.

The first indication of what could come next emerged on Wednesday, when crypto journalist Eleanor Terrett reported that House Democrats were discussing plans to expand Rep. Maxine Waters' Crypto Investor and Consumer Bill of Rights amendment into a broader market structure bill for the next Congress.

The proposal could revive Democratic provisions excluded from the CLARITY Act, including measures that would give the SEC greater supervisory authority over crypto markets while limiting the Commodity Futures Trading Commission's (CFTC) role. It could also introduce stricter ethics restrictions targeting President Donald Trump and other federal officials with crypto-related business interests. Democrats will control both chambers of Congress from January 2027, giving them greater influence over financial legislation, committee investigations and oversight of federal regulators. The developments have raised questions about the future landscape for crypto in the US.

Greater SEC oversight could reopen old regulatory disputes

One of the biggest questions is whether Democrats will seek to restore a regulatory approach that much of the crypto industry spent years challenging.

Under previous SEC leadership, enforcement actions became central to the agency's crypto approach. Companies faced lawsuits and disputes over whether their tokens and business activities fell under existing securities laws. The absence of clear classification rules also left exchanges, developers and investors uncertain about their obligations, driving many of these platforms offshore. The approach became a major point of friction between the industry and regulators. The Republican-backed CLARITY Act sought to address that divide by establishing a framework for digital asset markets, giving the CFTC more control over the trading environment.

A Democratic proposal that shifts more authority to the SEC could therefore reopen a fundamental disagreement over how crypto markets should be supervised and reclassify several cryptocurrencies and decentralized finance (DeFi) products as securities.

CLARITY's failure leaves a wider policy battle

The CLARITY Act passed the House in July 2025 with support from 216 Republicans and 78 Democrats. However, negotiations in the Senate stalled over regulatory jurisdiction, DeFi, consumer protection, stablecoin-related banking concerns and ethics restrictions involving Trump.

Republicans stated that their September revision incorporated 126 substantive changes requested by Democrats. Yet the legislation failed to secure the 60 votes needed to invoke cloture in a September 15 procedural vote.

Democratic control makes the bill's original Republican-led framework harder to advance without major changes. Instead, legislative focus could shift toward restrictions surrounding public officials with crypto interests.

Democrats have questioned whether elected officials should be able to profit from crypto ventures while influencing the rules governing the industry. With greater control of congressional committees, they will have greater capacity to investigate potential conflicts involving the Trump family and other officials.

On the other hand, the GENIUS Act established a federal framework for payment stablecoins. Although it passed with bipartisan support, banking groups have continued to warn that stablecoin rewards could draw deposits away from traditional lenders. Democrats could seek additional safeguards around stablecoin products and their impact on the banking system.

However, Democratic control does not necessarily mean an end to crypto legislation. Lawmakers from both parties have supported establishing clearer rules for digital assets, even when they disagree over which agencies should supervise the market and how strict the rules should be.

The White House will also remain under Republican control, meaning any major legislation will need to pass through the President before it becomes law. The President also retains the capacity to appoint leaders of federal regulatory agencies, subject to congressional approval.

AI slowdown could drag down crypto prices alongside equities

However, the crypto market could face risks from its rising correlation with AI stocks. Several Democrats have opposed acceleration in advanced AI and data center buildouts. If Congress pursues slowing down both, coupled with capital expenditure concerns across AI companies, it could limit growth in AI-related equities. That move may spill over into the crypto market and also cast a shadow of uncertainty around cryptocurrencies.

For example, the crypto market dipped more than 5% on November 5, with futures liquidations exceeding $1.1 billion within 24 hours after a sell-off in AI-related equities. This isn't the first time. Over the past few months, crypto prices have closely mirrored moves in AI stocks, especially during market downturns.

Despite that, macro factors such as interest rates and liquidity ultimately remain key drivers of risk assets and will likely determine the long-term market trajectory.

Conclusion

Crypto legislation will play a major role in how the crypto market evolves over the next few years, and the new Congress will shape that outlook. Market participants are waiting to see how lawmakers will approach the industry in January, which could push investors to the sidelines and lower immediate bull market expectations — though it remains uncertain whether lawmakers will revive the CLARITY Act during a lame-duck session before January.
